I applied for CLASP funding almost two years ago and did my first certification close to a year ago. I then received payment directly to my loan provider. Since then I have left my legal aid job for another non profit position. I just received a letter asking me to certify my employment (as per the three year service agreement). The service agreement states that I need to repay the benefit I received if I leave my legal services employment in less than three years, but also states, “I understand that on a case-by-case basis, the Department may waive, in whole or in part, the right to recover an amount owed under this program if, in the Department’s judgment, such recovery would be contrary to the public interest.” I’m wondering if you know how to state my individual case to request waiver and what sorts of information might be relevant to the Department in allowing the waiver.

I’m dealing with the same situation. I still provide legal services to low-income clients, but for the government, not a non-profit. I’ve been trying to track down someone at the Department of Education to ask these questions, starting first at the phone number provided on the annual certification form (904-974-9326). That number is for borrowers in default. I was directed by them to contact the Office of Ombudsman at 1-877-557-2575. They directed me to contact 877-699-1834, which is no longer a good number. It directed me to contact 404-974-9490, which is the default line again. I called back, and it became apparent that the Office of the Ombudsman was only able to assist with issues with the student loan, not for this program.
After not having any success at the numbers above, I looked up the Department of Education phone number and called them directly. I was then connected to the Federal Student Aid’s Research and Customer Care Center at 1-800-433-7327, at which point I discussed the issue with a representative. That representative is making inquiries, and will respond to me within two days.
It’s been a bit of a kerfuffle finding information about this program. I’ll post again with anything I learn, and would appreciate learning about any contact you’ve had as well. We certainly can’t be the only people with this issue.
