ICR, Direct Consolidation Loan, Married Filing Separately?

Hey Heather,

So I’ve been searching Google high and low for a clear answer to this question. My mom took out PLUS loans to help me pay for school. I know that PLUS loans are ineligible for IBR, but they can be eligible for ICR if they are consolidated. My mom has a government job so she is eligible for Public Loan Forgiveness, the only thing that I’m wondering is if she were to file her taxes separately from dad, would ICR only take her AGI into account? I seem to be finding conflicting information… I find some sites that say that the laws were changed on July 1, 2013 to allow “married filing separately” to count for ICR. Please please please, any information would be greatly appreciated. I’m about ready to pull my hair out of my head from the stress of this.

We filed as married filing separately in order to have just my AGI used to calculate the payment.  Look at the following, hope it helps.
