Student Loan Repayment with NO income

Please help me in this matter. For many reasons, I had a student loan in default for many years and I was under wage garnishment but I lost my employment few years ago and I never work and had any income since then. I got married a year ago and suddenly I received a statment from Florida Department of Education establishing monthly payments. I did some research that confirmed that by law my husband is not liable for the repayment of my student loan. So I contacted them saying that I have no income and my husband is not liable for my loan but they told me that the amount of payment calculated is based on the household income… but the only income we have is my husband income and by law is not liable for my student loan… so how they can claim money from my husband if by law he is not liable for my loan repayment????

It is not about your husband.  It is likely about your taxes.  If you filed your taxes “married filing jointly” your household income is used to determine repayment.  If you file “married failing separately” only your income is used.  You can amend your prior tax returns to filing separately.  However, that of course may have other tax implications.  You should speak with a CPA about the tax consequences.  In the alternative you can find a local VITA program, Volunteer Income Tax Assistance program sponsored by the IRS.  These preparers are not CPAs but do receive some training and offer free tax preparation for people with certain income limits.  The program should be starting up in the next few weeks.  Hope this helps.
