Ability to Benefit Discharge

Hi Heather,
I am currently looking into an ATB False Certification Discharge, and I believe I truly qualify for this. First, I did not have a HS Diploma or GED at enrollment and my transcripts indicate this as true and correct, BUT they have a handwritten note stating 30+ credits = diploma (although no curriculum is given). Also, there is not SCORE or ATB test copy anywhere in the transcripts, further showing I was not tested at the time of enrollment.

So based on these facts, would I be able to request a discharge?

You are absolutely right to get more information and pursue this.  Unfortunately, because of the rules governing attorneys, I cannot give you advice about your personal situation.  I am only able to give general legal information.  Please see this post about my limitations: http://askheatherjarvis.com/forums/viewthread/206/

I have some general information about Ability to Benefit Discharge here: http://askheatherjarvis.com/forums/viewthread/206/ including links to additional resources.  It might be a good idea for you to consult with an attorney in your state.  Information about finding one is available through the National Association of Consumer Advocates here: http://www.naca.net/

Best,
Heather

If the discharge is granted, a borrower is no longer obligated to repay the loan or any charges or costs associated with the loan. In addition, the borrower has the right to be reimbursed for all amounts paid on the loan, whether those payments were voluntary or involuntary.

So I went ahead with my ATB discharge request and after some back and forth, it was finally approved! I see Laura was also approved and was wondering how long before a discharge approval letter was/is received?
