My IBR payments to Direct Loans from November 2010-September 2012 would have been about $200/month lower if they had been based upon my adjusted gross income instead of my pay stubs.
An article at http://www.forbes.com/2010/03/22/income-based-repayment-overpay-personal-finance-student-loan-income.html stated that Congress intended for IBR payments to be based upon AGI, rather than gross income, and that the US Department of Education was aware of a problem of people being overchaged under IBR based upon gross income. An April 2, 2010 posting at http://www.ibrinfo.org/update_4210.vp.html stated that the DOE was then in the process of determining how it would deal with past overpayments.
Do you know whether the DOE has developed a procedure for addressing this problem, whether I might have a claim, and what my next steps might be? A year ago, I mailed a letter about this problem to the DOE, but never received a response. Thank you very much for any information or guidance.
Follow up: just to clarify, the letter I sent a year ago to the DOE was addressed to the Direct Loan Servicing Center, Borrower Services Department.
