Private Student Loan in Collections and I’m being sued while still in school

Hello,

I am in need of advice and help. I currently have one private student loan that has defaulted and I’m being sued for at the moment. I found out there was an issue with the student loan about a year ago because I applied for a credit card and was denied. I then investigated the situation and found out what the issue was. When I called the bank that the loan came from, they said the loan was already sent to collections and they told me to contact their lawyer. When I contacted the lawyer, I told them this has to be a mistake because I’ve been a registered student the entire duration of the loan. It doesn’t even make sense to me how every other loan is still in deferment except this one, because if that was the case then all of my private loans would be in default.

So, they told me to send in information that proved I was a student, and I sent them the information that my student account and financial aid office told me to send, but the lawyer’s office said it wasn’t enough information.

I later received papers for a lawsuit in this matter. I am currently handling the lawsuit situation with a motion to quash because I was given legal advise from the Legal Service Center at DePaul University.

With all this being said, my main question is how do I prove to the bank that I have been and am a current student. Who should I contact in order to get to the bottom of the issue and resolve the situation. I would contact the bank again but that leads me no where.
