Hi, Heather. I’ll keep this as brief as possible. My ex-spouse and I have an FFEL Consolidation Loan. Upon our divorce in 2006, our divorce papers stated I was only responsible for about 30%, and upon repayment (it was in forbearance at the time) he would be responsible for his portion.
Fast forward to 2015…we are now in IBR repayment and he’s refusing to pay his portion (in addition to refusing to pay full child support for two teenagers). I have a good job, but my ex is “self-employed” to avoid garnishments.The loan is now over $200K, and I’m making the payments to protect my credit. Is there anything I can do, or is my only option to sue him in civil court for the amount he’s not paying? I know that the feds don’t recognize divorce papers when it comes to “splitting” a consolidation loan. I don’t live in North Carolina, so the attorney-client relationship is not a problem here. I just need some guidance…do you know of any programs available that help someone in my situation?
